What is a Title Register?

The title register contains the key details relating to the property, including a description of the property and any rights that may benefit the property, the information about the person who owns the property and any restrictions upon their power to deal with the property, and even further information such as mortgages or rights that may adversely affect the property. The Title Register might refer to other filed deeds which are sold separately and can be found here, and can include rights, restrictions, covenants and other matters.

We provide an official copy of the Title Register, which is admissible in a court to the same extent as the original. A person is entitled to be indemnified by the registrar if he or she suffers loss by reason of a mistake in an official copy.

What is a Title Plan?

The Title Plan shows the general extent of the property registered under the title number shown. Title plans are prepared by HM Land Registry on the latest Ordnance Survey map available at the time of registration and are not updated as a matter of course. The plan does not normally show who owns boundary features, such as fences and hedges (for that matter we advise you to purchase the Title Register.

We highly recommend examining the title plan in conjunction with the title register information (you can find a value package designed just for that – insert slim title deeds package link), because there may be entries in the title register which clarify the extent of the title and color references that are shown. The title plan may also contain references to such matters as registered leases and the routes of beneficial or adverse easements (such as rights of access).

Title Deeds & Other Deeds

Both Title Registers and Title Plans are title deeds, which prove legal title to a property, and are filed and registered against the property’s title number at HM Land Registry. But, in addition to those deeds, there are some more official title deeds that might prove vital to you concerns (as you might saw in your Title Register, given that you already purchased one). Among those deeds, you can find different kinds of ancillary documents which detail the rights and obligations affecting the property such as transfers, conveyances, easements, etc. We will attempt to supply transfers, conveyances and deeds as a priority over leases and charges. If there are specific documents that you require, please state them in the additional information box on your order.

We provide an official copy of those title deeds, whether you need a specific one, or all the deeds we can find (up to 4 deeds per purchase), which are admissible in a court to the same extent as the original. A person is entitled to be indemnified by the registrar if he or she suffers loss by reason of a mistake in an official copy.

Tenures

or: What’s the difference between freehold and leasehold?

During you order you will be asked to specify the tenure that you require, whether it is a Freehold, a Leasehold or a Commonhold (the last one, is the least common, despite its name).

If you own the freehold for land or a building you own it outright which means you own both the property and the land on which the property stands - it’s yours until you sell it or give it away. Most houses are freehold.

If you own the leasehold for land or a building you own it for a fixed period of time, and You own the internal space, fittings, floor and walls. Most flats are leasehold - the blocks they're in are usually freehold.

Please note, only if you mentioned that you are not sure what is the required tenure during your order, we will provide the title that covers the property you ordered the deed for. If a Leasehold title relates to a specific flat while the Freehold related to entire building, we will supply the Leasehold. But , if both the Leasehold and the Freehold relates to the same property, we will supply the Freehold (as it is far superior to a Leasehold).
